Overtake is a co-operative party game published by Toast Mobile.
By downloading or playing it, you agree to these terms. If you do not agree,
please do not use the app.
Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence
to use Overtake on devices you own or control, for your own non-commercial
entertainment. You may not sell, rent, sublicense or redistribute the app,
attempt to reverse engineer or decompile it except where that restriction is
prohibited by law, or use it in a commercial venue or paid event without our
written permission.
The Expansion
- The Expansion is a one-time purchase, not a subscription.
There is no recurring charge and nothing to cancel.
- It is tied to your Apple or Google store account, not to a profile with us.
Use Restore in the app to recover it on another device signed
in to the same store account.
- All payments and refunds are handled by Apple or Google, not by
us. We cannot issue, see or reverse a charge. Refund requests go
through the store you bought from, under that store's policy.
- Prices and the contents of the Expansion may change over time. Anything you
have already bought stays unlocked.
Calls you write
Overtake lets you write your own calls. These are stored on your own
device only. We never receive them, never store them on our servers,
and cannot see or moderate them. When you host a game, your calls are sent to
the other players in your room so the game can be played — so treat them as
things you are saying out loud to the people you are with, and do not write
anything you would not want that room to read. You are responsible for the
calls you write and share.
Playing with other people
Rooms are temporary and code-based. Anyone with the code can join, so share
it only with the people you are actually playing with. Do not use the app to
harass anyone, and do not attempt to disrupt, overload or gain unauthorised
access to the game's servers or to other players' devices.
Availability and changes
Overtake needs a network connection to play with others, and parts of its
content are delivered from our servers. We may update, change or discontinue
the game or any part of it, and we do not promise uninterrupted or error-free
service. We may suspend access if it is necessary to protect the service or
other players.
Age
Overtake is not directed at children under 13. If you are under the age of
majority where you live, you may use the app only with the involvement of a
parent or guardian, who accepts these terms on your behalf.
No affiliation
Overtake is an independent game. It is not affiliated with, endorsed by, or
sponsored by any motorsport series, governing body, team, circuit or driver.
All commands in the game are generic motorsport terminology. Any trade marks
referred to remain the property of their owners.
Our intellectual property
The app, its artwork, sounds, text and design are owned by Toast Mobile and
protected by copyright and other laws. These terms give you a licence to play
the game, not any ownership of it.
Disclaimer and liability
The app is provided "as is" and, to the fullest extent
permitted by law, without warranties of any kind, whether express or implied,
including fitness for a particular purpose and non-infringement. To the fullest
extent permitted by law, Toast Mobile is not liable for indirect, incidental,
special or consequential damages, and our total liability relating to the app
is limited to the amount you paid for it in the twelve months before the claim.
Nothing here limits liability that cannot be limited by law, and some
jurisdictions do not allow certain exclusions, so parts of this section may not
apply to you. You may also have consumer rights that these terms do not
affect.
If you bought through the App Store
These terms are between you and Toast Mobile, not Apple. Apple is not
responsible for the app or its content, and has no obligation to provide
maintenance or support for it. If the app fails to conform to any applicable
warranty, you may notify Apple and Apple will refund the purchase price; to the
maximum extent permitted by law, Apple has no other warranty obligation.
Toast Mobile is responsible for addressing any claim relating to the app,
including product liability, any failure to conform to legal requirements, and
consumer protection or intellectual property claims. Apple and its subsidiaries
are third-party beneficiaries of these terms and may enforce them against
you.
Governing law
These terms are governed by the laws of the State of Oklahoma, United
States, without regard to its conflict-of-law rules, and the state and federal
courts located in Oklahoma have exclusive jurisdiction — except where the law
of your country or state of residence gives you the right to bring proceedings
locally.
Changes to these terms
If these terms change materially, the date at the top of this page changes
with it, and the updated version is published here. Continuing to use the app
after that means you accept the revised terms.
